1. WEBSITE OWNER

The domain www.pulcherrimacatania.it (hereinafter referred to as the “Portal”) and its Content, or any part thereof – including, but not limited to, text, images, videos, audio, etc. – (hereinafter also referred to simply as “Content”) are the property of and owned by Catania PULCHERRIMA srl, located at Via Vittorio Emanuele II – 95131 Catania (CT), email: Info@pulcherrimacatania.it

Catania PULCHERRIMA srl manages the content of the Portal itself and any services or products made available through it.

2. OBJECT

The Portal has been created to provide a space managed by Catania PULCHERRIMA srl where Users (hereinafter “Users”) can find out about the Project’s activities and view the texts of official documents.

The website contains numerous links to other organisations and institutions, including those other than Catania PULCHERRIMA srl.

The purpose of these Terms of Use is to inform visitors to the Portal who view the Content available on it regarding the ownership of such Content by Catania PULCHERRIMA srl, or by third parties from whom Catania PULCHERRIMA srl has obtained authorisation for its use, as well as the rules of conduct governing navigation on the Portal and the use of the relevant Content as set out herein.

3. CONTENT AND UPDATES

The Content on the Portal consists of the material uploaded to it as of the date of the last update.

The Portal may contain links (e.g. links to social media, links to third-party websites, etc.) for which Catania PULCHERRIMA srl accepts no responsibility.

4. ACCESS AND USE

Access to and viewing of the Portal’s Content are available to the User free of charge. They are intended for personal use only and for non-commercial purposes. The reproduction and collection of the Content for purposes other than personal use are expressly prohibited without prior written authorisation from Catania PULCHERRIMA srl. The User is not authorised to make any modifications or to disseminate and/or transfer the Content, even partially, of this Portal, as further specified below.

The User’s access to and use of the Portal and its Content must in all cases comply with the principles of good faith and fairness, in accordance with morality and public order. The User is expressly prohibited from using the Content and any products or services available on the Portal for commercial purposes and, in any case, for carrying out activities contrary to the law, morality or public order.

5. USER RESPONSIBILITY

The User, or their legal representatives or guardians in the case of minors or persons under legal disability, are solely responsible for navigating the Portal correctly and for using its Content in accordance with these Terms of Use.

The User undertakes to make appropriate use of the Content and any products and services available on the Portal and, in any event, not to use them to (i) engage in activities that are unlawful, illegal or contrary to good faith and public order; (ii) disseminate content or propaganda of a defamatory, racist, sexist, xenophobic, violent, pornographic or clearly unlawful or illegal nature, or which defends terrorism or infringes human rights; (iii) cause damage to the physical and logical systems of Catania PULCHERRIMA srl, its suppliers or third parties, including by introducing or spreading computer viruses or other physical or logical systems capable of causing such damage and/or impeding their normal use and operation in any way; (iv) attempt to access and, where applicable, use other users’ email accounts and alter or manipulate their messages.

The User also undertakes not to use the Portal for fraudulent purposes and, more generally, not to engage in any conduct that may damage the reputation of the Pulcherrima Project or the interests and rights held by Catania PULCHERRIMA srl or any third parties. Catania PULCHERRIMA srl will pursue and/or discourage any conduct by the User that damages either the Project or any third parties.

No User may include on their website, blog, forum or any social network a link, hyperlink, framing or similar link that redirects to URLs of Portal Content or Portal profiles without the written authorisation of Catania PULCHERRIMA srl.

Should Catania PULCHERRIMA srl detect any link of this nature, it shall be fully authorised to take action to remove such a link and, where appropriate, to inform the competent authorities of the infringement.

Furthermore, without prejudice to the monitoring of compliance with the provisions of these Terms of Use, if a User detects or becomes aware of any misuse, inappropriate use or use that contravenes any of the rules contained in the Terms of Use, they may contact Catania PULCHERRIMA srl via the channels indicated in point 8.

6. DISCLAIMER by CATANIA PULCHERRIMA srl

Catania PULCHERRIMA srl accepts no liability for any content not produced by Catania PULCHERRIMA srl or published under its name or trademarks which may cause confusion as to the origin of such content or any trademarks, thereby improperly attributing them to the Portal’s Content.

Furthermore, Catania PULCHERRIMA srl accepts no liability for information contained on third-party websites or blogs that may be linked, whether authorised or not, via links or other means to the Portal.

Similarly, Catania PULCHERRIMA srl is not liable for any security breaches that may occur due to the use of computers infected with computer viruses or for any consequences arising from browser malfunction or the use of outdated browser versions.

Catania PULCHERRIMA srl accepts no liability for damages of any kind caused by the User’s improper use of the Portal. Similarly, Catania PULCHERRIMA srl reserves the right to remove any comments or contributions that violate human dignity, are discriminatory, xenophobic, racist or pornographic, constitute offences against young people or children, public order or public safety, or which, in its opinion, are unsuitable for publication.

7. INTELLECTUAL AND INDUSTRIAL PROPERTY

The Portal and its Content are protected by the copyright laws in force in Italy and by international copyright laws. The Content of the Portal is the property of Catania PULCHERRIMA srl or of any third parties who have authorised its use.

The User is not authorised to modify, publish, transmit, share, transfer for use in any capacity, reproduce (beyond the limits specified below), adapt, distribute, perform, grant access to or commercially exploit in any way the Content or services (including software, images, icons, links, as well as their graphic design and source codes) of this Portal, even partially, without the express written authorisation of Catania PULCHERRIMA srl.

Reproduction of the Content is permitted using the tools made available by the Portal. More specifically, it is possible to share the Content, where this has been made possible by Catania PULCHERRIMA srl, via the main social media platforms (e.g. Instagram, Facebook) by clicking on the icons located next to the reproducible content. In any case, no form of commercial exploitation of such reproduction of the Content is permitted.

Similarly, trademarks or distinctive signs are the exclusive property of Catania PULCHERRIMA srl or, where applicable, of third parties, unless otherwise specified. The User must at all times respect all intellectual and industrial property rights relating to the Portal and the Content displayed therein, which are the property of Catania PULCHERRIMA srl or any third parties. The transfer of intellectual property rights relating to the Portal or its Content by the User is expressly prohibited.

8. NOTIFICATION OF INFRINGEMENT OF RIGHTS

Anyone who discovers that their content has been published on the Portal without their consent, thereby infringing intellectual or industrial property rights, privacy rights, image rights or any other rights, may notify Catania PULCHERRIMA srl by:

• registered letter with return receipt, sent to Catania PULCHERRIMA srl, Via Raddusa, 2 – 95131 Catania (CT);
• email: by sending a message to the following email address: info@pulcherrimacatania.it with the subject line “Infringement of Rights”.

In both cases, the request must be accompanied by the following information, failing which it will not be considered:

• identification of the content (in sufficient detail to enable Catania PULCHERRIMA srl to locate it within the Portal) or of the personal data or protected rights that have been infringed;
• sufficiently detailed identification of the complainant to enable Catania PULCHERRIMA srl to contact them (email address and telephone number);
• a copy of an identity document enabling the reporter to be identified;
• a signed statement in which the reporter affirms that the above information is true and that they are the legitimate owner (or authorised to act on their behalf) of the rights allegedly infringed.

9. USE OF LINKS AND SOCIAL MEDIA

The hyperlinks on the Portal may direct the User to web pages on websites other than this one, which are considered to be of potential interest to the User. The User acknowledges and agrees that Catania PULCHERRIMA srl has no control over the content of such sites and, as a mere third party, bears no responsibility for the content and/or material, including advertising, published on such sites or external resources, nor for their privacy policies.

The Portal uses features of certain so-called social media ‘buttons’ such as Twitter, Instagram and others. Social media platforms allow users to create links to their social media profiles to save or share them with their contacts on the aforementioned platforms.

Without the User’s intervention, the Portal does not send any data to the respective social networks, with the exception of the viewing of videos on the Portal which, by default, involve access to YouTube, for example.

Subject to these exceptions, in order to use the social media buttons, the User must activate them by clicking on them. They remain active until deactivated again. Once activated, a direct connection is established with the server of the relevant social network. The content of the button is then transmitted directly from the social network to the User’s browser, from where it is displayed on the website. Once a button has been activated, the social network may retrieve data, regardless of whether or not the User interacts with the button. If the User is logged into a social network, the latter is able to link the visit to the website to the relevant User account. If the User is registered with a social network, to prevent the social network from linking the visit data to the Portal, the User must log out of the respective social network before activating the buttons.

Catania PULCHERRIMA srl has no influence whatsoever over the scope of the data that social networks collect via their buttons. The social networks’ data usage policies provide information on the purpose and scope of the data they collect, how such data is processed and used, the rights available to the User, and the settings the User can select to protect their privacy. For further information regarding the scope and purpose of the collection and processing of your data, please consult the data protection policies of the aforementioned social media platforms, which are responsible for protecting your data in relation to their services and/or content.

10. TERMS OF USE OF THE PORTAL VIA MOBILE DEVICES

All the provisions set out herein apply to any access the User makes to the Portal, including via a mobile device, regardless of its nature or technology.

In this regard, it should be noted that, even in the case of a connection to a so-called fixed network, Catania PULCHERRIMA srl does not charge any fee for accessing the Portal via the device, but that the User’s mobile or fixed-line operator will apply the tariff agreed by the User for the transmission and reception of data. The cost of the connection is borne exclusively by the User. Catania PULCHERRIMA srl is not liable for any restrictions that the mobile operator may have imposed and which could prevent the normal functioning of the network, nor for any disruptions, delays or impediments to the User’s use of the Portal’s Content, whether or not connected to the network, as also specified in the previous point.

Catania PULCHERRIMA srl shall also not be liable if the use of such devices prevents the User from accessing all or part of the Portal and its Content.

11. AMENDMENTS AND UPDATES

Catania PULCHERRIMA srl reserves the right to amend and update, without prior notice, the Content, products and services, and the configuration and layout of the Portal, as well as to remove them and to restrict or prevent access to them, either temporarily or permanently. Consequently, under no circumstances shall Catania PULCHERRIMA srl be liable for the consequences of any interruptions, as it cannot guarantee the reliability, availability or continuity of the Portal.

Catania PULCHERRIMA srl may replace or modify, at any time, including for technical reasons, the provision of services or products. Catania PULCHERRIMA srl reserves the right to amend these Terms of Use to update their content; it is the User’s responsibility to check periodically for any changes.
